Your Privacy Rights in Montana
HIPAA StandardNo significant enhancements. Montana has strong patient privilege in its rules of evidence (protecting confidentiality), and a Patients' Bill of Rights for hospitals that includes the right to privacy and to approve or refuse release of information, echoing HIPAA. No shortened timeline or special consent law beyond requiring consent for disclosures not covered by other exceptions. Montana law does require that if a provider denies a patient access to records (for example, a psychiatrist thinking it could harm the patient), the provider's refusal and reason must be documented, and the patient can designate another provider to review the record. This gives a small additional path to access in denial situations.
